Richard Fisher

Richard’s legal career spans 25 years. Clients describe him as “determined, thorough, and commercially astute”.

He has been a partner at Temple Bright LLP in London since 2015 having previously been a partner at City law firm DAC Beachcroft LLP. Prior to his legal career Richard worked at Cushman & Wakefield Chartered Surveyors and HSBC.

Richard has been instructed in numerous disputes involving professional firms, businesses, individuals, insurers and litigation funders over the years.  His clients have ranged from PLCs to small businesses and individuals.

Richard has extensive experience of acting for claimants and defendants in many mediations. He has therefore had ample opportunity to consider the approach adopted by many different mediators in order to understand what works well.

Richard’s mediations have often involved third parties such as insurers and litigation funders. He therefore understands well the commercial dynamics from all parties’ perspectives.

Richard trained with Clear ADR and is a CMC Registered Mediator. He is available to mediate civil and commercial disputes throughout the UK.

Robert Hogarth

Robert was Senior Partner of City law firm RPC from 2008 to 2014. He left RPC in May 2018 to focus on mediation and risk analysis after over 30 years as a partner handling construction and real estate disputes for owners, contractors and insurers. Robert was awarded Client Choice UK construction lawyer of the year in 2013.

In his time Robert won many trials (and, importantly, also lost some) as well as acting for a wide range of claimants and defendants at countless mediations. He therefore has a comprehensive understanding of the legal and commercial factors in disputes gained over many years.

Robert has multiple ideas about how mediation can be made even more effective particularly around the early involvement of the mediator in order to provide a process for focussed preparation prior to the mediation.

Robert also has a particular expertise in modelling litigation risk and in 2022 brought to market ground-breaking AI software, SettleIndex. SettleIndex provides a sophisticated but intuitive and user-friendly solution for fully risk assessing disputes.

A mediator is employed primarily to guide parties through a process. What Robert has found is that his extensive experience enables him to make that challenging where necessary, but always collaborative. These are qualities that distinguish good mediators from simply messengers.

Robert was Editor of ‘Construction law for the Insurance Industry’ in its second edition with Oxford University Press. He was also on TeCSA’s panel of adjudicators from its inception until 2019. In addition to construction and real estate, his specialist knowledge includes professional negligence, PFI, outsourcing and insurance.

Robert trained with ADR Group and the London School of Mediation and is a CMC Registered Mediator. He is available to mediate civil and commercial disputes throughout the UK.
